CASE UPDATES FOR AUGUST 2016

Decker v. I. E. Miller;
Simmons v. CUDD Energy Services, Inc., et. al.
COLE, EASLEY, SCIBA & WILLIAMS and PAGEL WEIKUM keep the pressure on big oil with a week of hearings on two large cases. Partners Justin L. Williams and Jeff Weikum will be in Federal Court in Bismarck and State Court in Williston this week in the Scott Decker v. I. E. Miller and Robert Todd Simmons v. CUDD Energy Services, Inc., et. al., cases. The Decker case is set for trial later this year and Simmons in April of 2017 as the firms continue to seek justice for injured oil field workers. In Simmons the firms will argue for including punitive damages against CUDD. Williams stated that the two were claiming on behalf of Simmons that Cudd used the wrong type elevator to lift the tubing, failed to properly inspect the pipe and failed to perform a search for the elevators after the case began, hid the elevators during discovery and then altered the elevators from their accident condition.

Pyle v. XTO
Meanwhile, the firms have signed to represent snubbing supervisor Justin Pyle, one of the workers injured in the recent explosion and fire at the XTO well site near Watford City. Weikum indicated they expect to file suit shortly in that case. Weikum says that the initial evidence is that XTO improperly failed to “kill” the well prior to snubbing out of the hole with a “hole” in the tubing allowing an uncontrollable escape of gas.

Overcash v. Jones Contracting
PAGEL WEIKUM and COLE, EASLEY, SCIBA  & WILLIAMS, expect to try the Darrell Overcash v. Jones Contracting and Ian O’Neal case in December of 2016. The case involves a highway accident between the Jones Contracting vehicle driven by O’Neal, which struck the Overcash vehicle from behind at a high rate of speed. Overcash’s vehicle was knocked across the traffic lanes where it was struck by an 18 wheeler traveling in the opposite direction. As a result of the accident Darrell Overcash was killed, leaving behind a widow and two young children. Williams stated, “We believe this was a preventable accident that will result in large damages.”
